TERMS AND CONDITIONS – LEGALLY BINDING UPON SIGNATURE

By signing this application or otherwise registering for the Orfeo Music Festival (“OMF”), I hereby agree to the following legally binding Terms and Conditions:

1. Acceptance of Terms

I affirm that I have read, understood, and fully accept all OMF Terms and Conditions, policies, and deadlines. I assume complete financial responsibility for any damages to property caused by my actions or negligence, as well as for any medical expenses incurred during my participation in OMF.

2. Application and Participation

I certify that all information provided in this application is complete and accurate to the best of my knowledge, and that the submitted audition materials represent my own unaltered performance. Submission of an application does not guarantee admission. OMF reserves the sole and final right to accept or deny any applicant.

3. Commitmentand Conduct

I agree to participate for the full duration of the festival and to abide by all OMF rules, local and state laws, and policies. I acknowledge that OMF may remove any participant—without refund—for misconduct, disruptive behavior, violations of applicable laws, or failure to comply with OMF regulations.

4. Festival Regulations

Participants must strictly comply with all festival regulations.

Violation of any rules including below may result in immediate dismissal from the Festival without refund:

  • Absolutely no consumption of alcohol by minors.

  • Possession or use of illegal drugs, controlled substances, or firearms is strictly prohibited.

  • Participants must uphold standards of honesty and academic integrity. Plagiarism, falsification, or cheating will not be tolerated.

5. Duties and Assignments

I agree to participate in the OMF office and stage assistance program and will fulfill my assigned duties as outlined in my individual schedule. I will also attend any extra rehearsals assigned by faculty.

6. Scholarship Recepients

Scholarship recipients may receive additional assignments as a condition of their award. Non-compliance may result in immediate forfeiture of the scholarship and possible dismissal.

7. Administrative Communication Policies

During the Festival, administrative personnel will prioritize festival operations. Non-urgent communications from non-participants may not receive responses during this time.

Upon arrival to the Festival, every participant is solely responsible for verifying the individual schedule and requesting corrections in writing within 48 hours. Failure to do so waives the right to dispute schedule errors.

OMF reserves the right to modify faculty, artist, and event rosters at any time without prior notice and without obligation to provide replacements or refunds.

The Festival Office is closed during the following dates and will not respond to emails or phone calls during these periods:

  • From the end of the Festival through September 20

  • December 15 – January 10

  • March 15 – March 31

Please plan all communications and requests accordingly.

8. Concert and Housing Assignments

Concert assignments are final once posted.

Housing assignments are determined by OMF and are final. Participants may not request changes to room assignments after arrival. If a participant is dissatisfied with their assigned accommodation for any reason, it is solely the participant’s responsibility to secure and fully fund alternative lodging at their own expense. OMF is under no obligation to assist with or reimburse for such arrangements.

9. Liability Waiver

I hereby release and hold harmless OMF, its directors, employees, affiliates, and agents from any and all liability for loss, damage, illness, injury, or theft occurring during my participation in the Festival. OMF is not responsible for lost, stolen, or damaged personal property, including instruments. Participants are strongly encouraged to secure their own insurance.

I will be financially liable for any property damages incurred at OMF venues.

10. Media Release

I grant OMF full, perpetual, royalty-free rights to use photographs, audio, and/or video recordings of my likeness or performances for promotional, archival, educational, or research purposes, in any format or media, without further notice or compensation.

11. Tuition and Fees

Tuition includes access to the following services: private lessons, masterclasses, ensemble rehearsals, performance opportunities, piano accompaniment, performance classes (if offered), choir (if offered), practice room usage, and general access to festival facilities. For participants registered for room and board, tuition also covers two meals per weekday and shared housing. A single room will be provided only if the applicable supplement has been paid by registration due date. Each participant will also receive a Certificate of Completion and one festival t-shirt.

Guest package covers attendance at festival concerts, participation in choir (if offered), use of facilities, attendance as an observer at coaching sessions and classes, a festival t-shirt, and shared accommodations.

All offerings are contingent upon scheduling, faculty availability, and operational needs. OMF reserves the right to modify, substitute, or cancel any component of the program without prior notice. No refunds or reductions in fees will be granted due to changes in scheduling, personnel, or program structure.

12. Payment Terms, Cancellations, and Financial Responsibility

I understand that I am not registered until all fees are paid.
By submitting payment, the cardholder affirms that the charge is authorized and will not be disputed. Charges appear as “OMF.” All refund requests will be evaluated solely under OMF policy and applicable governing law.

Upon acceptance to the Orfeo Music Festival, all fees must be paid in full unless a written and signed payment plan has been explicitly authorized by OMF.

All fees are strictly non-refundable, including but not limited to tuition or program participation fees, housing costs, any additional events, services, or add-ons.

Outstanding balances must be resolved immediately upon notification. Failure to make timely payment may result in:

• Loss of access to housing or instructional activities
• Withholding of participation in performances or classes
• Removal from the Festival without refund

No exceptions will be made under any circumstances, including but not limited to voluntary withdrawal, personal illness or injury, travel disruptions, delays, or cancellations, inability to obtain a visa, changes of personal preference after enrollment.

OMF assumes no liability for any costs incurred through airlines, travel agencies, or third-party vendors, including but not limited to: flight cancellations, missed connections, lost baggage, or changes in itinerary.

Once registration is complete, refunds will not be issued under any condition.

By registering, each participant affirms their full understanding and acceptance of these financial terms, and agrees to be held personally responsible for the timely and complete payment of all fees.

For all billing-related inquiries or exceptional circumstances, participants must contact the Festival Office in writing prior to any posted deadlines.
