TERMS AND CONDITIONS – LEGALLY BINDING UPON SIGNATURE

By submitting an application or registering for the Orfeo Music Festival (“OMF”), the participant agrees to the following legally binding Terms and Conditions.

1. Acceptance of Terms

By applying or registering, participants confirm that they have read, understood, and accepted all Festival policies, deadlines, and Terms and Conditions. Participants assume full financial responsibility for any property damage caused by their actions or negligence and for any medical expenses incurred during Festival participation.

2. Application and Admission

Submission of an application does not guarantee admission. OMF reserves the sole and final right to accept or deny any applicant. Participants certify that all submitted materials are accurate and represent their own unaltered work.

3. Participation and Conduct

Participants agree to attend the Festival for its full duration, comply with all Festival policies and applicable laws, and maintain professional and respectful conduct. OMF reserves the right to dismiss participants without refund for misconduct, disruptive behavior, legal violations, or failure to comply with policies.

4. Festival Regulations

Participants must comply with Festival rules including the prohibition of alcohol consumption by minors, possession or use of illegal drugs, controlled substances, or weapons, and violations of standards of honesty and academic integrity. Violations may result in immediate dismissal without refund.

5. Duties and Assignments

Participants agree to fulfill assigned Festival responsibilities including stage or administrative assistance when applicable. Scholarship recipients may receive additional duties as a condition of their award, and non-compliance may result in scholarship forfeiture or dismissal.

6. Administrative Policies

Participants are responsible for reviewing their individual schedules upon arrival and submitting corrections in writing within 48 hours. Failure to do so constitutes waiver of schedule disputes. OMF may modify faculty rosters, programming, scheduling, and assignments at any time without obligation to provide replacements or refunds. 

Administrative personnel prioritize Festival operations during the Festival period and non-urgent communications from non-participants may not receive responses. 

The Festival Office is closed 

from the end of the Festival through September 20

from December 15 through January 10 

from March 15 through March 31

Participants must plan communications accordingly.

7. Location and Venues

The Festival is held in Bressanone (Brixen), Italy, with activities occurring at affiliated venues within the surrounding region. Venue assignments, rehearsal spaces, and performance locations may vary.

8. Concert and Housing Assignments

Concert and housing assignments are final once issued. Participants dissatisfied with housing may secure alternative accommodations at their own expense, and OMF has no obligation to assist with or reimburse alternative arrangements.

9. Liability Waiver

Participants release and hold harmless OMF, its directors, employees, affiliates, and agents from liability for injury, illness, theft, loss, or damage occurring during Festival participation. OMF is not responsible for lost or damaged personal property including instruments, and participants are strongly encouraged to obtain personal insurance. Participants remain financially liable for property damages caused at Festival venues.

10. Media Release

Participants grant OMF perpetual, royalty-free rights to photograph, audio-record, and video-record their likeness and performances for promotional, archival, educational, or research purposes without compensation.

11. Tuition and Program Inclusions

Tuition may include private lessons, masterclasses and workshops, ensemble, choir, or opera scenes rehearsals, performance opportunities, access to concerts, piano accompaniment when applicable, practice facilities, Summer Cultural Residency programming if enrolled, housing and meals if selected, a certificate of completion, and a Festival t-shirt. Program components are contingent upon scheduling, faculty availability, and operational needs, and OMF may modify programming without refund or fee reduction.

12. Payment Terms and Refund Policy

Registration is confirmed only upon full payment unless a written payment plan is approved. All fees are strictly non-refundable including tuition, housing, program participation, and add-ons. No exceptions will be made for voluntary withdrawal, illness or injury, travel disruptions or delays, visa issues, schedule or personnel changes, or personal preference changes. OMF assumes no liability for travel-related costs or third-party expenses. By submitting payment, the cardholder affirms authorization of charges and agrees not to dispute them except as permitted by applicable law. Failure to resolve outstanding balances may result in restricted participation or dismissal without refund. For all billing-related inquiries or exceptional circumstances, participants must contact the Festival Office in writing prior to any posted deadlines.

13. Residency Program

Participants enrolled in the Summer Cultural & Artistic Residency Program engage in workshops, seminars, guided observation, and cultural programming. Residency participation does not include private instruction unless separately registered, and residency participants remain subject to all Festival policies and financial terms.

14. Program Modification

OMF reserves the right to modify faculty, programming, repertoire, scheduling, housing, venues, and services as necessary for operational reasons without refund.

15. Governing Law

These Terms and Conditions are governed by the laws of the State of Texas and the United States. Festival activities conducted in Italy occur within an international educational setting and do not establish employment or contractual relationships under Italian law.

16. Force Majeure

OMF shall not be liable for failure or delay in performance of any obligation due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, government restrictions, travel bans, war, terrorism, civil unrest, labor disputes, utility failures, venue closures, or transportation disruptions. In such circumstances, OMF reserves the right to modify, postpone, relocate, or cancel Festival programming without refund, except where required by applicable law.

17. Medical Authorization and Emergency Care

Participants authorize OMF and its representatives to obtain emergency medical treatment on their behalf if necessary during Festival participation. Participants agree to be financially responsible for any medical services provided. OMF assumes no responsibility for medical costs and makes no guarantees regarding availability of medical services in Italy or elsewhere.

18. Minor Participants

Participants under the age of 18 must have a parent or legal guardian accept these Terms and Conditions on their behalf. The parent or guardian assumes full financial responsibility and liability for the minor participant and authorizes emergency medical treatment as described herein.

19. Dispute Resolution

Any disputes arising from participation in OMF shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in the State of Texas in accordance with applicable arbitration rules. Participants waive the right to participate in class actions or jury trials to the fullest extent permitted by law.
